Terms of Use

Please read these Terms of Use ("Terms") carefully before using Beat Mix ("the app"). By downloading, installing, or using the app, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Beat Mix, you agree to these Terms of Use and our Privacy Policy. If you do not agree to these Terms, do not use the app.

2. Description of Service

Beat Mix is a music playlist sorting application that:

• Syncs playlists from your Apple Music library
• Looks up audio metadata (tempo, energy, key, genre, etc.) for your tracks
• Groups songs into preset and custom mixes based on audio features
• Provides in-app playback using Apple MusicKit
• Optionally reads heart rate from Apple Watch to dynamically match music to your workout intensity
• Allows exporting sorted mixes as new Apple Music playlists

3. Subscriptions and Billing

Beat Mix offers optional auto-renewable subscription plans ("BeatMix Pro") that unlock additional features, including unlimited BPM matches, unlimited HR Play sessions, and the ability to save preset and mix edits.

Pricing and Billing

BeatMix Pro is available as a monthly or yearly auto-renewable subscription. Current pricing is displayed in the app at the time of purchase. All prices are in your local currency as determined by the App Store.

Auto-Renewal

Your subscription will automatically renew at the end of each billing period (monthly or yearly) unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

How to Cancel

You can manage or cancel your subscription at any time through your Apple ID account settings: open the Settings app on your iPhone > tap your name > Subscriptions > BeatMix Pro > Cancel Subscription. Cancellation takes effect at the end of the current billing period.

Refunds

All purchases are processed by Apple. To request a refund, visit reportaproblem.apple.com or contact Apple Support. Beat Mix does not process payments or issue refunds directly.

Subscription Lapse

If your subscription expires or is cancelled, your account will revert to the free tier. You will retain access to all free features, including up to 100 BPM matches and 3 HR Play sessions. Any previously matched BPM data will remain available, but you will not be able to save preset or mix edits until you resubscribe.

4. Requirements

To use Beat Mix, you need:

• An iOS device running iOS 17.0 or later
• An active Apple Music subscription (for playback functionality)
• Permission to access your Apple Music library
• An Apple Watch with heart rate sensor (optional, for Heart Rate Play)
• HealthKit permission (optional, for Heart Rate Play)

5. Apple Music and MusicKit

Beat Mix uses Apple's MusicKit framework to access your Apple Music library and provide playback. Your use of Apple Music is subject to Apple's own terms and conditions. Beat Mix is not affiliated with, endorsed by, or sponsored by Apple Inc.

Apple Music is a trademark of Apple Inc., registered in the U.S. and other countries.

6. User Conduct

You agree not to:

• Use the app for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the app
• Interfere with or disrupt the app's services or servers
• Attempt to gain unauthorized access to the app's backend services
• Use the app to infringe on any intellectual property rights

7. Intellectual Property

The app, including its design, code, features, and branding, is owned by Beat Mix and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

8. Third-Party Services

Beat Mix integrates with the following third-party services:

• Apple MusicKit — for music library access and playback
• Apple HealthKit — for reading heart rate data (optional, Heart Rate Play feature only)

These services are subject to their own terms and conditions. We are not responsible for the availability, accuracy, or performance of third-party services.

9. Health Data and Heart Rate Play

The Heart Rate Play feature uses Apple HealthKit to read heart rate data from your Apple Watch. By using this feature, you acknowledge that:

• Beat Mix is not a medical device and does not provide medical advice, diagnosis, or treatment
• Heart rate data is used solely to select music matching your current intensity level
• You should consult a physician before beginning any exercise program
• Beat Mix is not responsible for the accuracy of heart rate readings from your Apple Watch or other sensors
• Heart rate data is processed on-device only and is never stored or shared (see our Privacy Policy)

10. Disclaimer of Warranties

Beat Mix is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• The app will be error-free or uninterrupted
• Audio metadata will be available or accurate for all songs
• Heart rate readings will be accurate or available at all times
• The app will be compatible with all devices or iOS versions

11. Limitation of Liability

To the maximum extent permitted by law, Beat Mix and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to loss of data, loss of playlists, or inability to access your music.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised date. Your continued use of the app after changes constitutes acceptance of the updated Terms.

13. Termination

We reserve the right to terminate or suspend access to the app at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
